This Privacy Policy should be read together with the Terms of Service and Acceptable Use Policy. If you have questions, contact us using the information at the end of this Policy.

1.SCOPE

This Privacy Policy applies to Personal Information collected or processed by or on behalf of Dial Amp through: the Dial Amp website; the Dial Amp web application; dialing and communications functionality; CRM integrations, including Zoho CRM; CRM field mapping and configuration; CRM data importing and synchronization; telephone-number provisioning and management; call recording, where enabled; transcription, where enabled; voicemail and prerecorded voicemail functionality; analytics and reporting; customer-support interactions; sales and account-management interactions; APIs and integrations; optional artificial-intelligence or automated features, where offered; and other Dial Amp products and services.

Collectively, these are referred to as the "Services."

2.OUR ROLE

Dial Amp processes different categories of information in different capacities.

Account and Website Information

For Personal Information relating directly to Dial Amp customers, account holders, website visitors, prospective customers, and users, Dial Amp generally determines the purposes for which and means by which that information is processed.

Customer-Controlled Data

Customers may connect CRM accounts, import CRM records, access leads and contacts, initiate calls, create notes, record call outcomes, synchronize CRM information, or otherwise process information relating to their own customers, prospective customers, leads, and other contacts through Dial Amp.

For this information, the Dial Amp customer generally determines: which CRM accounts are connected; which modules and fields are accessed; which CRM fields are mapped; which records are imported into Dial Amp; which individuals are contacted; why those individuals are contacted; what information is displayed within Dial Amp; what information is written back to the CRM; whether optional recording, transcription, voicemail, or other functionality is enabled; and how the information is otherwise used.

In these circumstances, Dial Amp generally acts as a service provider or processor on behalf of its customer.

Customers are responsible for ensuring they have the legal authority to collect, use, disclose, upload, import, synchronize, record, or otherwise process Personal Information through Dial Amp.

If you have been contacted by a Dial Amp customer and have questions about that customer's use of your Personal Information, you should generally contact that business directly.

3.DEFINITIONS

"Customer" means an individual or organization that subscribes to or uses the Dial Amp Services.

"Customer Data" means information submitted to, imported into, synchronized with, created within, or otherwise processed through the Services on behalf of a Customer.

"Personal Information" means information about an identifiable individual or information that can reasonably be linked to an identifiable individual. The precise definition may vary under applicable privacy law.

"CRM Configuration Data" means information concerning the structure and configuration of a connected CRM, such as modules, fields, field names, field types, layouts, picklist values, API identifiers, and mapping configurations.

"CRM Record Data" means information contained within individual CRM records, including information relating to leads, contacts, accounts, deals, opportunities, activities, and other CRM records.

Personal Information generally does not include properly aggregated, anonymized, or de-identified information that cannot reasonably be used to identify an individual.

4.INFORMATION WE COLLECT

The information Dial Amp collects depends upon how you interact with the Services and which features you enable.

We may collect the categories of information described in the following sections.

5.ACCOUNT INFORMATION

When you register for or use Dial Amp, we may collect: name; business name; job title; email address; telephone number; account identifier; login information; authentication information; user role and permissions; subscription information; billing address; and other information you provide when creating or managing your account.

We use this information to establish and administer your account, authenticate users, communicate with you, provide customer support, process billing, and operate the Services.

6.BUSINESS AND CUSTOMER VERIFICATION INFORMATION

Dial Amp or its underlying telecommunications providers may require information concerning you or your organization for telecommunications, fraud-prevention, regulatory, carrier, security, or number-provisioning purposes.

This information may include: legal business name; operating or trade name; business address; business registration information; website; industry; business contact details; authorized representative information; intended use of Dial Amp; information concerning calling practices; geographic markets; telephone-number requirements; proof of address; proof of business presence; business identification documentation; and other information reasonably required by Dial Amp, telecommunications providers, carriers, or regulators.

We seek to collect only information reasonably necessary for the applicable verification purpose.

7.CRM CONNECTIONS

Dial Amp allows Customers to connect supported CRM platforms, including Zoho CRM.

When you connect a CRM to Dial Amp, you authorize Dial Amp to communicate with the CRM through its available APIs and other authorized integration methods.

The permissions granted to Dial Amp may allow us to retrieve information from and write information to the connected CRM as necessary to provide the functionality you configure.

Dial Amp accesses CRM information only in accordance with the permissions made available through the applicable CRM integration and the functionality selected by the Customer.

8.CRM CONFIGURATION AND FIELD INFORMATION

When you connect Zoho CRM or another supported CRM, Dial Amp may retrieve information concerning the structure and configuration of your CRM.

This may include: CRM organization identifiers; available CRM modules; module names; module configuration; field names; field labels; field API names or identifiers; field types; custom fields; picklist values; layouts; record-owner information; user information; field permissions; module permissions; and other CRM configuration or metadata made available through the applicable integration.

Dial Amp may retrieve this information so that Customers can configure the integration, including determining which modules and fields should be displayed, mapped, imported, synchronized, or updated through Dial Amp.

9.CRM RECORD DATA

Depending upon the Customer's configuration and the permissions granted through the CRM integration, Dial Amp may access CRM Record Data including: names; telephone numbers; email addresses; company names; mailing addresses; contact information; lead information; account information; deal or opportunity information; lead or contact status; custom-field values; notes; tasks; activities; call history; follow-up information; record ownership; CRM record identifiers; communication preferences; and other information contained within CRM records that the Customer has authorized Dial Amp to access.

The particular information accessible to Dial Amp depends upon the Customer's CRM configuration, permissions, modules, field mappings, and use of the Services.

10.IMPORTING CRM RECORDS INTO DIAL AMP

Dial Amp may allow Customers to select and import leads, contacts, clients, accounts, or other records from Zoho CRM or another connected CRM into Dial Amp.

When a Customer chooses to import records, selected CRM Record Data may be copied from the connected CRM and stored within the Dial Amp platform. The information imported depends upon the Customer's configuration and may include information such as: name; telephone number; email address; company; record identifier; record owner; lead or contact status; custom CRM fields; notes; follow-up information; and other mapped or selected information.

Connecting a CRM does not automatically mean that every record contained in the CRM is imported into Dial Amp. The information imported depends upon the functionality and selections made by the Customer.

11.WRITING INFORMATION BACK TO THE CRM

Depending upon the Customer's configuration, Dial Amp may create, modify, or synchronize records within the connected CRM.

This may include writing information such as: completed call activities; call dates and times; call durations; call outcomes; dispositions; notes; follow-up information; tasks; record status changes; recordings or links to recordings; transcripts or links to transcripts; and other information the Customer configures Dial Amp to synchronize.

The Customer controls the applicable configuration and is responsible for ensuring that Dial Amp has appropriate authorization to create or modify information within the CRM.

12.OWNERSHIP AND CONTROL OF CRM DATA

Connecting Dial Amp to a CRM does not transfer ownership of CRM information to Dial Amp.

As between Dial Amp and the Customer, the Customer retains its rights in Customer Data obtained from or synchronized with its CRM, subject to the rights of the individuals to whom the Personal Information relates.

Dial Amp processes CRM information to provide, maintain, secure, support, and improve the Services and as otherwise described in this Privacy Policy, our Terms of Service, and applicable agreements with the Customer.

We do not sell Customer CRM contact lists.

13.DISCONNECTING A CRM

Customers may disconnect Dial Amp from a connected CRM where that functionality is available through Dial Amp or the applicable CRM provider.

Disconnecting or revoking Dial Amp's authorization generally prevents Dial Amp from making future requests to the CRM using that authorization.

However, disconnecting a CRM does not automatically delete information that was previously imported into, synchronized with, or created within Dial Amp.

Previously imported information remains subject to the retention and deletion provisions of this Privacy Policy and the Customer's account controls.

14.TELEPHONE AND CALL INFORMATION

When the Services are used to make or receive calls, we may process information including: originating telephone number; destination telephone number; Dial Amp-assigned telephone numbers; caller identification information; call date and time; call duration; call status; answer status; connection information; voicemail detection results; call disposition; telecommunications-provider identifiers; call routing information; carrier information; call-quality information; call-error information; dialing-session information; and related technical metadata.

We use this information to provide calling functionality, calculate usage, provide reporting and analytics, troubleshoot issues, maintain security, prevent abuse, and operate the Services.

15.CALL RECORDINGS, AUDIO, VOICEMAILS, AND TRANSCRIPTS

Where enabled by the Customer, Dial Amp may process: live call audio; call recordings; voicemail recordings; prerecorded voicemail content; transcripts; notes generated from communications; call summaries; information derived from call content; and related communication information.

Recording and transcription functionality may be optional and dependent upon the Customer's configuration.

Customers are responsible for determining whether recording, monitoring, transcription, voicemail, or other processing of communications is lawful and for obtaining all notices and consents required by applicable law.

Dial Amp does not independently obtain recording or transcription consent from call participants on behalf of Customers.

16.TELEPHONE NUMBER INFORMATION

If Dial Amp provides, provisions, or manages telephone numbers, we may collect and process information including: telephone numbers assigned to an account; number-provisioning information; business identity information; geographic information associated with number eligibility; carrier-registration information; caller-name information; number-reputation information; spam, scam, or fraud labels; carrier complaints; traceback information; number usage; registration status; and information required by telecommunications providers.

We may share information reasonably necessary to provision, register, maintain, monitor, port, protect, or remediate telephone numbers with telecommunications providers, carriers, analytics companies, number registries, or other parties involved in providing telecommunications functionality.

17.BILLING INFORMATION

When you purchase Services, we may collect: billing contact information; billing address; subscription information; payment status; invoices; transaction identifiers; usage information; and limited information concerning your payment method.

Payment-card information may be processed directly by a third-party payment processor.

Dial Amp does not intend to store complete payment-card numbers unless specifically disclosed.

18.SUPPORT AND COMMUNICATIONS

If you communicate with Dial Amp, we may collect: your name; email address; telephone number; company information; support-ticket information; correspondence; screenshots; attachments; diagnostic information; CRM configuration information provided for troubleshooting; and any other information you choose to provide.

We use this information to respond to requests, troubleshoot problems, provide support, investigate issues, and improve the Services.

19.INFORMATION COLLECTED AUTOMATICALLY

When you visit our website or use the Services, we may automatically collect technical and usage information including: IP address; browser type; device type; operating system; referring page; pages or features accessed; session information; login activity; timestamps; application events; diagnostic information; system-performance information; error logs; interaction information; and usage information.

This information may be collected through server logs, cookies, SDKs, analytics technologies, and similar tools.

20.HOW WE USE PERSONAL INFORMATION

We may use Personal Information where reasonably necessary to: provide and operate the Services; establish and administer accounts; authenticate users; connect to CRM platforms; retrieve CRM modules and field information; provide CRM field mapping; import CRM records selected by Customers; display CRM information within Dial Amp; synchronize CRM information; create and update CRM records; create calling lists and dialing sessions; make and route telephone calls; provision and manage telephone numbers; provide caller identification functionality; process call dispositions; provide recordings and transcripts where enabled; provide voicemail functionality; provide analytics and reporting; calculate telecommunications and other usage; process payments; provide customer support; troubleshoot technical problems; maintain and improve the Services; develop and test new features; monitor system performance and reliability; protect account and system security; prevent fraud, spam, abuse, and misuse; enforce our Terms of Service and Acceptable Use Policy; investigate complaints; comply with carrier and telecommunications-provider requirements; respond to regulatory, traceback, carrier, or legal inquiries; comply with applicable law; communicate administrative information regarding accounts; send marketing communications where permitted by applicable law; and carry out other purposes identified when the information is collected.

We will not use Personal Information for a materially different purpose without appropriate notice or consent where required by applicable law.

21.LEGAL BASES AND CONSENT

The legal basis upon which we process Personal Information depends upon the jurisdiction, type of information, relationship involved, and circumstances.

Where Canadian privacy law applies, we collect, use, and disclose Personal Information with consent where consent is required, or as otherwise permitted or required by law.

The appropriate form of consent may depend upon factors including the sensitivity of the information and the reasonable expectations of the individual.

Where other privacy laws apply, we may process information based upon consent, performance of a contract, legitimate interests, compliance with legal obligations, or another lawful basis recognized by applicable law.

22.CUSTOMER RESPONSIBILITY FOR CUSTOMER DATA

Dial Amp Customers may provide or access Personal Information concerning individuals who do not have a direct relationship with Dial Amp.

Customers are responsible for: determining whether they are legally permitted to collect the information; determining whether they are legally permitted to import the information into Dial Amp; determining whether they are legally permitted to use the information through Dial Amp; providing privacy notices required by law; obtaining required consents; determining whether individuals may lawfully be contacted; responding to privacy requests concerning Customer-controlled information; and complying with applicable privacy, telecommunications, marketing, and consumer-protection laws.

Dial Amp does not determine whether a Customer is legally permitted to contact a particular individual merely because that individual's information exists within the Customer's CRM or Dial Amp account.

23.HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose Personal Information where reasonably necessary to provide and operate the Services, fulfil Customer instructions, protect Dial Amp and our users, or comply with applicable law.

Categories of recipients may include: telecommunications providers; telephone carriers; CRM providers; cloud-hosting providers; infrastructure providers; payment processors; customer-support providers; analytics providers; email providers; security providers; fraud-prevention providers; transcription providers; artificial-intelligence providers, where applicable; professional advisers; regulators; courts; law-enforcement authorities; and other service providers necessary to operate Dial Amp.

We do not permit our service providers to use Customer Data for their own unrelated purposes except where independently permitted or required by law.

24.CRM PROVIDERS

When a Customer connects Dial Amp to Zoho CRM or another CRM, information is exchanged between Dial Amp and the applicable CRM provider.

Information retrieved from the CRM may be stored and processed within Dial Amp as described in this Privacy Policy.

Information transmitted from Dial Amp back to the CRM is also subject to the Customer's relationship with the CRM provider and that provider's applicable privacy practices and terms.

Dial Amp does not control the independent privacy practices of CRM providers.

25.TELECOMMUNICATIONS PROVIDERS AND CARRIERS

To provide communications functionality, we may disclose information to telecommunications providers, carriers, number registries, analytics companies, and other parties involved in delivering or protecting telephone services.

Information may be used for purposes including: routing calls; provisioning telephone numbers; validating Customer information; complying with telecommunications requirements; registering telephone numbers; supporting caller identification; assessing number reputation; investigating spam, scam, or fraud complaints; responding to traceback requests; preventing telecommunications abuse; and troubleshooting call-delivery issues.

Such providers may independently process certain telecommunications information as required by law or their own regulatory obligations.

26.SERVICE PROVIDERS AND SUBPROCESSORS

Dial Amp relies upon third parties to operate portions of the Services.

Depending upon the functionality used, third parties may process Personal Information on our behalf for purposes including: cloud infrastructure; telecommunications; CRM integration; authentication; payment processing; email delivery; analytics; customer support; security; fraud prevention; transcription; artificial intelligence; and other technical services.

We seek to use service providers that maintain privacy and security safeguards appropriate to the nature of the information they process.

Dial Amp may add, replace, or remove service providers as our technology and Services evolve.

27.LEGAL AND REGULATORY DISCLOSURES

We may disclose Personal Information where we reasonably believe disclosure is necessary or appropriate to: comply with applicable law; comply with a court order; respond to a subpoena or other lawful legal process; respond to a regulator; respond to a telecommunications carrier; respond to an industry traceback request; investigate suspected fraud or unlawful activity; investigate suspected violations of our Acceptable Use Policy; protect Dial Amp, our Customers, consumers, or other individuals; enforce our agreements; or establish, exercise, or defend legal rights.

Where legally permitted and appropriate, we may notify an affected Customer of a request for information.

28.BUSINESS TRANSACTIONS

If Dial Amp or its business is involved in a merger, financing, acquisition, corporate reorganization, sale of assets, insolvency proceeding, or similar transaction, Personal Information may be disclosed or transferred as part of that transaction.

We will take reasonable steps to require recipients to handle Personal Information consistently with applicable privacy requirements.

29.WE DO NOT SELL CUSTOMER DATA

Dial Amp does not sell Customer CRM records, contact lists, call recordings, transcripts, or other Customer Data to data brokers or other third parties for their independent marketing purposes.

Dial Amp does not acquire ownership of a Customer's CRM database merely because information is imported into or processed through Dial Amp.

If our practices materially change, we will update this Privacy Policy and provide any notices, consent mechanisms, or opt-out rights required by applicable law.

30.ADVERTISING

Dial Amp may use standard website analytics and marketing technologies to understand website traffic, measure advertising effectiveness, and market Dial Amp to prospective Customers.

Customer CRM records, contact lists, call recordings, voicemail recordings, and call transcripts are not used by Dial Amp for targeted advertising.

If Dial Amp engages in activities considered "selling," "sharing," targeted advertising, or cross-context behavioural advertising under applicable privacy law, we will provide notices and opt-out mechanisms required by that law.

31.COOKIES AND SIMILAR TECHNOLOGIES

Our website and Services may use cookies and similar technologies to: authenticate users; maintain sessions; remember preferences; protect accounts; prevent fraud; measure website usage; diagnose technical problems; improve functionality; and measure marketing effectiveness.

Some cookies may be necessary for the Services to function. Other cookies may be optional where required by applicable law.

You may be able to control cookies through your browser or any cookie-preference tools we make available.

32.ARTIFICIAL INTELLIGENCE AND AUTOMATED FEATURES

Dial Amp may offer optional artificial-intelligence, machine-learning, transcription, summarization, analysis, or other automated functionality.

Where such features are offered, information processed may include: call audio; call recordings; transcripts; CRM information; prompts; Customer-provided content; call metadata; and information generated from those inputs.

Dial Amp may use third-party technology providers to provide this functionality.

Unless expressly disclosed and agreed otherwise, Dial Amp does not use identifiable Customer CRM data, contact data, call recordings, or transcripts to train general-purpose artificial-intelligence foundation models.

33.AGGREGATED AND DE-IDENTIFIED INFORMATION

Dial Amp may create aggregated, anonymized, statistical, or de-identified information derived from use of the Services.

Such information may include statistics concerning: call volume; call duration; answer rates; call outcomes; dispositions; feature usage; system performance; connection quality; CRM integration performance; and other operational trends.

We may use such information for lawful purposes including: analytics; benchmarking; improving Dial Amp; product development; telecommunications optimization; fraud prevention; abuse prevention; capacity planning; and research.

We will not attempt to re-identify properly de-identified information except where permitted by law, including where necessary to test the effectiveness of de-identification techniques.

34.CROSS-BORDER PROCESSING

Dial Amp operates from Canada but may use service providers located in Canada, the United States, and other jurisdictions.

Accordingly, Personal Information may be processed, stored, or accessed outside the province, state, or country where the Customer or individual is located.

For example, information transmitted to telecommunications, CRM, cloud, transcription, analytics, or other technology providers may be processed in jurisdictions in which those providers operate.

When Personal Information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, governments, regulators, law-enforcement authorities, or national-security authorities in accordance with applicable law.

Where required, Dial Amp uses contractual, organizational, technical, or other safeguards designed to provide appropriate protection for Personal Information transferred to service providers.

35.DATA RETENTION

Dial Amp retains Personal Information only for as long as reasonably necessary for the purposes for which it was collected or as otherwise permitted or required by law.

Retention periods may vary based upon: the type of information; Customer configuration; subscription status; the feature involved; contractual requirements; telecommunications-provider requirements; security requirements; fraud-prevention requirements; backup and disaster-recovery procedures; dispute-resolution requirements; and legal or regulatory obligations.

When information is no longer reasonably required, Dial Amp may delete, anonymize, or de-identify it, subject to applicable legal requirements.

36.CRM DATA RETENTION

Information imported from Zoho CRM or another connected CRM may remain stored within Dial Amp after the CRM integration is disconnected.

Disconnecting or revoking Dial Amp's CRM access prevents future access through that authorization but does not automatically delete information previously imported into or created within Dial Amp.

Customers may be provided with functionality to delete imported records or may contact Dial Amp where deletion assistance is required.

Upon termination of a Dial Amp account, imported CRM information will be deleted or de-identified in accordance with Dial Amp's then-current retention and deletion procedures, subject to reasonable backup periods and information Dial Amp is permitted or required to retain for legal, billing, security, fraud-prevention, dispute-resolution, or compliance purposes.

Customers are responsible for retaining copies of records they are legally or operationally required to preserve.

37.CALL RECORDING AND TRANSCRIPT RETENTION

Call recordings, voicemail recordings, transcripts, and related information may be retained according to Customer configuration, product functionality, subscription level, and Dial Amp's applicable retention procedures.

Customers should not rely upon Dial Amp as their sole legally required repository for communications records unless expressly agreed in writing.

Customers are responsible for exporting or retaining records they are legally required to preserve.

38.SECURITY

Dial Amp uses reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, disclosure, loss, misuse, alteration, or destruction.

Depending upon the applicable system and information, these safeguards may include: encryption in transit; encryption at rest where appropriate; authentication controls; access controls; restricted administrative access; secure API authentication; logging and monitoring; software and security updates; backups; vendor management; incident-response procedures; and internal security practices.

No Internet transmission, telecommunications network, API, cloud service, or electronic storage system can be guaranteed to be completely secure. Accordingly, Dial Amp cannot guarantee absolute security.

39.CRM AUTHORIZATION SECURITY

Dial Amp may use authorization mechanisms made available by CRM providers, such as OAuth, to connect Customer CRM accounts.

Where supported, these mechanisms allow Dial Amp to access authorized CRM information without requiring Dial Amp to obtain or store the Customer's CRM password.

Customers are responsible for: maintaining the security of their CRM accounts; controlling which users are permitted to authorize integrations; reviewing permissions granted to Dial Amp; removing access for unauthorized users; and promptly revoking access if compromise is suspected.

40.SECURITY INCIDENTS AND DATA BREACHES

Dial Amp maintains procedures for responding to suspected privacy and security incidents.

Where required by applicable law, Dial Amp will notify appropriate regulators, affected Customers, or affected individuals of a breach of security safeguards.

Where Dial Amp processes affected information on behalf of a Customer, we may notify that Customer so the Customer can assess and comply with its own legal obligations.

41.YOUR PRIVACY RIGHTS

Depending upon applicable privacy law, individuals may have rights to request: access to Personal Information; correction of inaccurate Personal Information; deletion of certain Personal Information; withdrawal of consent; information regarding how Personal Information is used or disclosed; a portable copy of certain Personal Information; restriction of certain processing; opt-out of certain processing; or other privacy rights recognized by applicable law.

These rights may be subject to exceptions and limitations.

Requests concerning Personal Information controlled directly by Dial Amp may be submitted to: privacy@dialamp.io

We may need to verify your identity before responding.

42.INDIVIDUALS CONTAINED WITHIN CUSTOMER CRM DATA

If your Personal Information was provided to Dial Amp by one of our Customers — for example, because you are a lead, prospect, client, customer, or other contact contained within that Customer's Zoho CRM account — the Dial Amp Customer generally determines why your information is being processed.

You should normally direct requests concerning that information to the organization that collected your information or contacted you.

Where appropriate and required by law or contract, Dial Amp will assist its Customer in responding to valid privacy requests.

43.CANADIAN PRIVACY RIGHTS

Dial Amp is based in British Columbia, Canada.

Depending upon the circumstances, our handling of Personal Information may be governed by: British Columbia's Personal Information Protection Act ("PIPA"); Canada's Personal Information Protection and Electronic Documents Act ("PIPEDA"); and other applicable provincial or federal privacy legislation.

Canadian individuals may have rights including: accessing Personal Information held about them; requesting correction of inaccurate or incomplete information; withdrawing consent, subject to legal or contractual restrictions and reasonable notice; asking how their Personal Information has been used or disclosed; asking questions concerning our privacy practices; and making a complaint regarding our handling of Personal Information.

Individuals may also have the right to complain to an applicable privacy regulator, including the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada.

44.UNITED STATES PRIVACY RIGHTS

Residents of certain U.S. states may have additional rights under applicable state privacy laws.

Depending upon the jurisdiction and whether the applicable law applies to Dial Amp, these rights may include: the right to know or access Personal Information; the right to correct Personal Information; the right to request deletion; the right to obtain certain Personal Information in portable form; the right to opt out of certain sales or sharing of Personal Information; the right to opt out of targeted advertising; rights relating to certain forms of profiling or automated decision-making; the right not to be discriminated against for exercising privacy rights; and in certain jurisdictions, the right to appeal a decision concerning a privacy request.

Dial Amp will honour rights required by applicable law. Requests may be submitted to: privacy@dialamp.io

We may verify your identity before fulfilling a request.

45.CALIFORNIA PRIVACY RIGHTS

If the California Consumer Privacy Act, as amended ("CCPA"), applies to Dial Amp's processing of your Personal Information, California residents may have rights provided under that law.

Dial Amp does not sell Customer CRM records, contact lists, call recordings, or transcripts for monetary consideration.

To the extent Dial Amp engages in conduct considered "selling" or "sharing" Personal Information under California law, Dial Amp will provide the legally required disclosures and opt-out mechanisms.

Where Dial Amp processes Personal Information solely on behalf of a business Customer as a service provider or contractor, privacy requests concerning that information should generally be directed to the applicable Customer.

46.INTERNATIONAL USERS

Dial Amp may be used by Customers located outside Canada and may process information relating to individuals in multiple countries.

Additional privacy laws may therefore apply depending upon the Customer, the individual, the location of processing, and other circumstances.

Where Dial Amp is legally required to provide additional privacy rights, we will do so.

Customers using Dial Amp to process Personal Information concerning individuals in other countries are responsible for determining whether additional privacy, consent, data-transfer, telecommunications, or other legal requirements apply to their activities.

47.CHILDREN

Dial Amp is a business communications service and is not directed to children.

Individuals under 18 are not permitted to create a Dial Amp Customer account unless expressly authorized by Dial Amp and permitted by applicable law.

We do not knowingly solicit Personal Information directly from children for purposes of creating Dial Amp business accounts.

Customer CRM records may contain information supplied by Customers concerning individuals of different ages. Customers remain responsible for ensuring that their collection and use of such information is lawful.

If Dial Amp learns that Personal Information has been collected directly from a child contrary to applicable requirements, we will take reasonable steps to address the situation.

48.SENSITIVE INFORMATION

Dial Amp is not intended to serve as a repository for highly sensitive information unless we specifically state otherwise.

Customers should avoid importing, displaying, or storing unnecessary sensitive Personal Information through Dial Amp.

Unless Dial Amp expressly supports the applicable use case and appropriate contractual and technical protections have been established, Customers should not use Dial Amp to store: complete payment-card numbers; passwords or authentication credentials belonging to third parties; Social Security Numbers or Social Insurance Numbers; government identification numbers; highly sensitive financial credentials; biometric identifiers; Protected Health Information regulated by HIPAA; or other information requiring specialized regulatory safeguards beyond those normally associated with business communications software.

Because Customers may map custom CRM fields into Dial Amp, Customers are responsible for ensuring that the CRM fields they select for import, display, or synchronization are appropriate for processing through Dial Amp.

49.HEALTH INFORMATION AND HIPAA

Dial Amp is not intended to function as a HIPAA-compliant repository for Protected Health Information unless Dial Amp expressly agrees otherwise in writing and any legally required Business Associate Agreement has been entered into.

The availability of custom CRM fields, call recording, transcription, CRM integration, or other functionality does not mean that Dial Amp is suitable for processing Protected Health Information.

Customers should not map or import CRM fields containing Protected Health Information unless Dial Amp has expressly approved the applicable use case.

50.BIOMETRIC INFORMATION

Dial Amp does not use call audio for the purpose of creating biometric voiceprints or identifying individuals based upon unique biometric voice characteristics unless expressly disclosed in connection with a specific feature and permitted by applicable law.

Ordinary processing of call audio for communications, transcription, analytics, quality, or similar functionality is not intended to create biometric identification profiles.

51.MARKETING COMMUNICATIONS

We may send communications concerning Dial Amp products, features, promotions, or services where permitted by applicable law.

You may unsubscribe from marketing emails using the unsubscribe mechanism included in the message or by contacting us.

Opting out of marketing communications does not prevent Dial Amp from sending transactional or administrative communications concerning: your account; billing; security; support; service changes; telecommunications matters; legal notices; or operation of the Services.

52.DO NOT TRACK AND PRIVACY PREFERENCE SIGNALS

Some browsers provide "Do Not Track" or other privacy preference signals.

Because standards concerning these signals vary, Dial Amp may not respond to all browser-based Do Not Track signals.

Where applicable law requires Dial Amp to recognize a legally valid universal opt-out preference signal or similar mechanism, Dial Amp will comply with that requirement.

53.THIRD-PARTY WEBSITES AND SERVICES

The Services may contain links to or integrations with websites and services operated by third parties.

Dial Amp is not responsible for the independent privacy practices of those third parties.

You should review the privacy policies of third-party services before providing Personal Information to them.

54.CUSTOMER PRIVACY PRACTICES

Dial Amp does not control the independent privacy practices of its Customers.

Customers may obtain information from sources outside Dial Amp and may have their own privacy policies, consent practices, legal obligations, and business purposes.

Dial Amp is not responsible for a Customer's independent collection, use, disclosure, or retention of Personal Information.

55.CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect: changes to the Services; new features; changes to CRM integrations; changes to telecommunications functionality; changes to service providers; changes in our privacy practices; changes in applicable law; or other operational requirements.

The current version will be posted on our website with an updated Effective Date.

Where required by applicable law, we will provide additional notice of material changes.

56.PRIVACY OFFICER

Dial Amp has designated responsibility for privacy compliance within the organization.

Questions, concerns, privacy requests, or complaints may be directed to our Privacy Officer at: privacy@dialamp.io

57.COMPLAINTS

If you have concerns regarding Dial Amp's handling of Personal Information, we encourage you to contact our Privacy Officer so that we can investigate and respond.

Nothing in this Privacy Policy limits an individual's right to contact an applicable privacy regulator.

Depending upon the circumstances and jurisdiction, the applicable regulator may include the Office of the Information and Privacy Commissioner for British Columbia, the Office of the Privacy Commissioner of Canada, a United States state privacy regulator, or another competent authority.
